Parents to Sue Maker of Metal Baseball Bats Over Son’s Injury
May 19th, 2008 . by TexasFredWAYNE, N.J. - A New Jersey couple, whose son was struck in the chest with a line drive, is planning to sue the maker of a metal baseball bat used in the game.
Two years ago, Steven Domalewski was pitching when the ball slammed into his chest and stopped his heart. He was resuscitated but now has brain damage and is severely disabled.
The family contends metal baseball bats are inherently unsafe for youth games because the ball comes off them much faster than from wooden bats. The lawsuit will also be filed against Little League Baseball and a sporting goods chain that sold the bat.
An attorney says Domalewski will need millions of dollars worth of medical care for the rest of his life.
The bat maker says while it sympathizes with Steven and his family, the bat is not to blame for the injury.

I’m a father, I have grown children and I have grandchildren, and as such let me say, my sympathies go out to the Domalewski family over this injury and the disability their son has suffered, as a parent I know it must be a gut wrenching experience.
That said, I have to ask this, how damned stupid are you people??
Saying that the maker of the bat, Little League Baseball and the sporting goods chain that sold the bat are all responsible for your son’s injury is about as stupid as these people that want to sue gun manufacturers over someone being shot.
If I remember correctly, when my son was playing baseball and football, we had to sign a release and we had to acknowledge that there was some danger involved and that we would not hold the school responsible as long as they didn’t engage in negligence.
I’m guessing that the Domalewskis signed a similar release and I am also guessing that a judge is going to throw them and the shyster that convinced them to do this right OUT of court.
A while back my Aunt was killed in a collision with an 18 wheeler, maybe we oughta sue Kenworth for selling the trucking company that truck, and maybe we need to sue Bridgestone because of the tires and Bendix because they made the brakes that the driver didn’t apply when he ran a stop sign and broadsided my Aunts car, makes about as much sense as these dunderheads suing the bat maker.
Nothing personal folks but pull your heads out of your asses and deal with this in a mature and SANE fashion, maybe the ball does come off of a metal bat faster, maybe your son should have reacted quicker, did you think of that??
I know, this sounds cold and heartless to some of you, but someone needs to slap the crap out of Mom and Dad and knock some sense into their heads, life offers NO guarantees, accept that fact for what it is, and then realize that in life, things happen that are no ones fault, it’s just life and that is exactly what happened to your son, he was living life and he got a bad deal.

This was a terrible and tragic accident but to point the finger outwards is ridiculous on this. Why do people always look for a reason or throw blame without realizing that sometimes accidents just happen and that there was nothing that could have been done to prevent them. To sit there and say that the bat manufacturer knowingly produced a product that was dangerous for kids is absurd. This boy would have been hit just as hard regardless if the bat was wooden or aluminum. Little League is only 45 feet from mound to plate. Not to mention, you throw,catch and hit a ball, which in essence is a projectile. You as parents should have known what the dangers are in Baseball BEFORE your son played, not sue people AFTER he was hurt because of your own ignorance. To the parents, why don’t you go and sue the manufacturer of the baseball as it is a projectile or the glove maker, you can say it wasn’t big enough to catch the ball. Or, why not sue the manufacturer of the uniform he was wearing, you can say there should have been some kind of padding in there to protect kids from getting hit by the ball. One more thing for the parents, you had no problem BEFORE this accident with your son pitching or using an aluminum bat did you? So I ask you, if this did not happen to your son but rather to someone else would you have lobbied on behalf of them if their son/daughter was hit like this? Probably not, because it didn’t happen to you and you wouldn’t care, and your son would still be using the same aluminum bat that he has always used and you as parents wouldn’t care that he was.

Grief makes people do all kinds of irrational things.
It was an accident; trying to place blame when no one was at fault, just tends to make people less sympathetic to their tragedy.
I feel bad for them, but find it foolish to initiate a lawsuit that has no merit.
Fred, really – how can you POSSIBLY apply COMMON SENSE to this situation?
If you keep calling for PERSONAL RESPONSIBILITY people aint’ gonna like ya nearly as much as they do now…

I remember a few years back a guy sued Sears because he backed over his own kid with a riding mower. He blamed Sears because they hadn’t installed some kind of safely device that would prevent that happening. DUH! Apparently he never heard of looking behind him before backing up.
These kind of lawsuits are all about ‘free money’ and some damned lawyer wanting to fill his pockets as well.
Kids should all be wearing chest protectors. Safe-Heart is awesome (Google it) and kids love wearing it. This is whether they’re using metal or wooden bats.
They might as well sue god for making the leather that was put on the ball and sue the animal the leather was taken off of :-/
