Supreme Court says Americans have right to guns

June 26th, 2008 . by TexasFred

WASHINGTON (AP) - The Supreme Court says Americans have a right to own guns for self-defense and hunting, the justices’ first major pronouncement on gun rights in U.S. history.

The court’s 5-4 ruling strikes down the District of Columbia’s 32-year-old ban on handguns as incompatible with gun rights under the Second Amendment. The decision goes further than even the Bush administration wanted, but probably leaves most firearms laws intact.

The court had not conclusively interpreted the Second Amendment since its ratification in 1791. The amendment reads: “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.”

The basic issue for the justices was whether the amendment protects an individual’s right to own guns no matter what, or whether that right is somehow tied to service in a state militia.

We now have a right to own guns?? Well, isn’t that special?!?!

It seems to me that right has been in effect ever since the 2nd amendment was written. Many anti-gun lobbies have tried their best to interpret it otherwise, and constitutional scholars have been trying to tell them that the original intent of the Framers of the Constitution was exactly what is read, word for word, because when you get right down to it, we ARE a militia if this nation comes under attack.

In 1941, when Japan attacked the U.S. Naval forces at Pearl Harbor, there was a serious reason they attacked where they did, and not on the west coast of this nation. They didn’t fear our military, they feared the ARMED U.S. citizen and the insurgency that they were certain they would face.

We, The People are the very reason that no foreign power has even tried to invade this nation, we always have been, we always will be, by God, lets keep it that way.

All I can tell you fine folks is this, if you have em, secure em, if you don’t have em, you’d be well advised to buy a few, become highly proficient in their use and invest in precious metals, brass, copper, lead, things of that nature.

You never know when they might change their minds.

What’s with the 5-4 splits lately?

Never really sure which five (or four) to cheer and support anymore…

Never know when they might change their minds … that’s true. I’m actually surprised they were this logical, with some of their recent decisions.

Yes you better buy up all the guns/ammo you want/can, because we never know what the future holds.

“…you’d be well advised to buy a few, become highly proficient in their use and invest in precious metals, brass, copper, lead, things of that nature.”

Good advise. I figure that Hassan Obama and the dim-a-crits will win this fall and by this time next year the price of guns and ammo will be so high that most of us cannot buy either. What they can not ban legally they will ban by taxing it off the shelves.

I buy fifty to 100 rounds of ammo of some kind about twice a month..I think the next time I buy I will get some more double ought buck shot and maybe a couple of boxes of high brass # 4 12 gauge.

Have you seen the price of the GOOD 9mm? Damn..I think I’ll just keep a box of Hornady and stockpile the military rounds..

GuyK, in MY mind, the words *good* and *9mm* just don’t compute… :?

Looking good and a huge decision that the left is going to crucify their buddy Kennedy for, that’s for sure.

  6. comment number 6 by: Patrick Sperry

Well? Five to four yet again. That friends, is why I posted over at ACF that I was nervous, nervous as all hell.

It appears though that all the hard work that myself and others performed over many years bore fruit in the end.

More to come about all this I am sure!

I’m doin’ the Snoopy dance, but I’m still cautious.

  8. comment number 8 by: Aaron

Amen on your post Fred. In fact I just finished my carry permit class…should have my license by Sept. It will be nice to be able to make a purchase and not have to deal with the “waiting period” here in Florida.

Ditto on Kate’s comment. I am cautious as well, remember…where there is a liberal will, there is a way. I am sure the liberal knuckle draggers are feverishly looking for a way to negate this decision on the local levels.

Maybe it’s just my paranoia, but, the left will figure some way to get at our guns. Thet’re not going to lie down and roll over. They know that as long as we citizens are armed we will resist their socialist intentions toward this country. So dance and celebrate today, and be on the range at 06:00 tomorrow!

    Best regards!

    “…What’s with the 5-4 splits lately?…”

Kennedy leaned our way this time because he’s afraid of those angry, bible thumping, gun totin’ rednecks from the back woods of Pennsyvania…

You would think that the statement, “Right of the People to keep and bear arms shall not be infringed” would be pretty simple. Any young boy or girl with a 3rd grade education can explain it. Amazes me that 4 blacked robed lawyers can’t understand it.

  12. comment number 12 by: TexasFred

BobF, exactly right, the SCOTUS should never have had to make this ruling, one way or the other, but there’s some really STUPID libber, anti-gun asshats out there, plain English isn’t good enough for them apparently.

  13. comment number 13 by: Roland Hulme

Don’t normally agree with you, but that was a well written response!

  14. comment number 14 by: Kate

Perhaps if we put it in Spanish….they’ll understand better?

Una milicia bien regulada, siendo necesario a la seguridad de un estado libre, el derecho de la gente para conservarse y aguantar armas, no será infringida.

  15. comment number 15 by: Katie

Finally a ruling I agree with! A good day for the American citizen.

  16. comment number 16 by: Wendell Roy

Well, hoo-bee-doo, the SCOUS says we can, does it? Whata’ joke.

    Doc Roy

  17. comment number 17 by: Murray

I’ve got my guns, and I will keep them until I’m no longer breathing; regardless of any court decision. But it’s nice to know that the court has finally ruled in favor of the American people. Thank God for the conservative judges. Hmmm, wonder what presidents appointed them and what political party they belong to (lol)? As if I didn’t already know.

  18. comment number 18 by: Brendan Steinhauser

Now if I could just bring my concealed handgun into the district.. I guess that is a fight for another day.

Steven Breyer, Ruth Bader Ginsburg, John Paul Stevens, and David Souter should be impeached and imprisoned for betraying their oaths to defend and uphold the Constitution of the United States. They are traitors to our nation.

  21. comment number 21 by: Hoot Gibson

A 4-4-1 Supreme Court is ripe for the pickens from the King and Queen of the Marxists…Harry Hussain and his ever so lovely wife Michelle. A small 5-4 victory is indeed a victory, but for how long?

  22. comment number 22 by: Troy LaPlante

What is sad is that four out of nine wearers of black robes wanted to take that right away. Insane. I have been reading Scalia’s well written, poignant opinion.

  23. comment number 23 by: Wild Thing

I am thrilled and how sad is that. I mean it never even should have been a decision to be made it already existed. But due idiot 4 (Steven Breyer, Ruth Bader Ginsburg, John Paul Stevens, and David Souter ) that are constantly willing to turn this country into something in their own agenda it had me very nervous as to what the outcome would be.

Ditto to what you said……”All I can tell you fine folks is this, if you have em, secure em, if you don’t have em, you’d be well advised to buy a few, become highly proficient in their use and invest in precious metals, brass, copper, lead, things of that nature.”

  24. comment number 24 by: Basti

5-4 ruling we can keep our guns. That’s a very close ruling and the way I see it we’ll be f-ked in the near future. All its going to take is a Lefty POTUS and a Lefty Congress. (We could have that as soon as the next general election) The old judges will retire or die and new Lefty judges will be appointed. Then this ruling is revisited and we’re told we have no right to guns at all. That will be the signal for another Revolution where all bets will be off.

The Left is like Islam, they’re patient and when there is the slightest opening they pounce and what ever they pounce on is forever altered/destroyed.

  25. comment number 25 by: Top Gun

We were not given a right today, and we were also not given anything we did not already have.

The only decision handed down today was an outright admission of four SCOTUS justices of being full blooded Communists.

  26. comment number 26 by: ablur

The five four thing really bothers me. It makes you wonder if some back door dealing isn’t going on somewhere. I don’t recall a time where the SCOTUS has walked such a fine line on every decision.
Did they all get together and trade votes compromising our constitution?

Putting the right judges on the SCOTUS has got to be a priority of the coming election.

  27. comment number 27 by: Kate

We KNOW B. Hussein won’t do it ablur. Do we have much confidence that McFeingold would?

  28. comment number 28 by: TexasFred

Kate, some folks DO, I have no idea WHY, but they do…

I keep hearing that McCain is our only hope, well, if that’s the case, we really screwed…

  29. comment number 29 by: Kate

sigh…. Well, the alternative is Hussein, so I reckon we’re going to have to PRAY an awful lot! :?

  30. comment number 30 by: TexasFred

Pray for a GREAT VP and a sudden heart attack…

  31. comment number 31 by: Kate

    LMAO Yer killin’ me!

  32. comment number 32 by: ablur

Nothing beats dropping at the oath taking ceremony.

We are in for some rough times.

  33. comment number 33 by: Top Gun

You guys stop hanging your heads and kicking the can down the street.

We have our guns and they won’t do anything extremely stupid knowing that. Why do you think Kennedy voted the way he did?

This country will never be over until not just the last bullet will have been fired, but until the last breath is taken in from the last warrior fighting for it. Somehow, I don’t ever see that last breath being taken, or even coming close to it.

  34. comment number 34 by: Robert

Way to go for 5 judges, the other 4 are morons. AS always we have the libbers destroying the constitution and taking more rights away than any GWB.

I really wish I lived in America so I could enjoy some of the various gun rights other states have.

  35. comment number 35 by: Kate

We’ll welcome ya in Tennessee. :)

  36. comment number 36 by: Cary

Step over the line this-a-way, Robert - as long as you legally own it, you can carry it in the open in Arizona.

And the concealed class isn’t expensive or difficult.

We could do with more conservatives over here, anyway.

It is frightening to think that just one man held the vote that could have changed America forever!
