Mayoral Candidate Among 9 Busted in Fla. Bathroom Sex Sting

DAYTONA BEACH, Fla. — Police arrested nine people Thursday in a bathroom sex sting at the Volusia Mall, authorities said.

Among the nine were former Daytona Beach city commissioner and mayoral candidate Michael Shallow, and local high school teacher and athletic trainer David Behringer, police said.

All were charged with lewd and lascivious conduct, and exposure of a sexual organ.

Detectives were tipped off by Sears officials that sexual misconduct was taking place in its second-floor men’s restroom.

As a way to attract attention from another interested person, the men either cough, sneezed, tapped their feet, sometimes under the stall next to them, or they made loud zipper noises, police said.

“Most everything that’s occurring is nonverbal,” said Sgt. Jeff Hoffman, supervisor of the criminal suppression team.

OK, just to make this crystal clear, I’m NOT taking up for these pervs nor am I blasting the police, I’m guessing that there must be some serious evidence in play and that these arrests will stand up in court, but there are a few points of this story that I just have to comment on, I feel the need to point out what I’m getting from the original story…

The very 1st thing that hits me from the story is this, if you have allergies or a cold, NEVER go to a public restroom in Daytona Beach…

Coughing and sneezing are signs that you’re out trolling for trouser trout?? Who knew?? I thought it was just a good sign that maybe you had a cold or allergies…

Now I am not totally naive, I have seen and heard of the foot tap thing, that’s an oldie, hell, my father warned me about guys doing that crap back when I was a kid, so, no shock there, but God help you if ya gotta go do your business and you have some catchy little tune stuck in your head that just won’t go away, “Her name was Lola, she was a show girl“…

Loud zipper noises?? How in the hell do you make LOUD zipper noises?? I think it’s best if I just leave that one alone…

And the exposure of a sexual organ thing, I am seriously hoping they are referring to a blatant exhibition, because otherwise, just taking a leak is gonna be pretty tough, unless you stand on the pot and piss in your pants, then let it run off into the pot, at some point when taking a whiz, you gotta expose the thing…

I won’t even begin to write what I think about people that engage in these types of behavior but I will say this, the next time we go to the mall, I’m gonna pee BEFORE I go…

    Looks like the voters made the right choice for once by not electing Sears shopper and bathroom pickup queen Mayor Strangelove.

    Okay…now let me review my checlist of men’s bathrooms to avoid…

    Bathrooms at public parks…check.

    Bathrooms at airports…check.

    Okay, now I can check off bathrooms at Sears stores.

    Hmmmm…maybe I need to include JC Penny’s, too?

    Pretty soon, the safest restrooms for men will be at lesbian bars.

    I had a friend who worked for the Michigan Highway Department who said they had to place steel plates in the stalls of mens restrooms. They put the plates on the walls separating the stalls because the Sodomites would bore holes through them so they could peek at the person in the next stall.

    Let me say this off the top. I have no use for queers or pedophiles. Recently here in Columbus OH they arrested a high profile guy as a pedophile in a ’sting op’. They tricked him to coming to a place where he thought he was going to have sex with a 14 year old girl.
    Now all that said my problem with all this is the ‘entrapment issue’. All this is in my mind ‘entrapment’ and no matter what ‘entrapment’ is wrong.
    To me this is like the question, “Are you still beating your wife?” So you’re damned two ways.
    IMO, the cops have found ‘new meat’ for easy arrests is why this is so prominent now.
    BTW, you do have to take ‘old Johnson’ out in order to use the urinal.

    There’s only one reason cops would be in a filth-ridden public bathroom, and that’s if they’d had many complaints. No one, and I mean NO one WANTS to spend time doing anything like this, at least on my department.

    Point #1: Anyone, ANY ONE, trolling in a public restroom - or someone willing to do the nasty in a public restroom - is one sick puppy.

    Before you start complaining about entrapment Basti, you need to actually research not only the legal definition but also legal precedent. Judging by your statements thus far, you seem to think it means something other than it actually is.

    ENTRAPMENT - A person is ‘entrapped’ when he is induced or persuaded by law enforcement officers or their agents to commit a crime that he had no previous intent to commit; and the law as a matter of policy forbids conviction in such a case.

    However, there is no entrapment where a person is ready and willing to break the law and the Government agents merely provide what appears to be a favorable opportunity for the person to commit the crime. For example, it is not entrapment for a Government agent to pretend to be someone else and to offer, either directly or through an informer or other decoy, to engage in an unlawful transaction with the person. So, a person would not be a victim of entrapment if the person was ready, willing and able to commit the crime charged in the indictment whenever opportunity was afforded, and that Government officers or their agents did no more than offer an opportunity.

    On the other hand, if the evidence leaves a reasonable doubt whether the person had any intent to commit the crime except for inducement or persuasion on the part of some Government officer or agent, then the person is not guilty.

    In slightly different words: Even though someone may have [sold drugs], as charged by the government, if it was the result of entrapment then he is not guilty. Government agents entrapped him if three things occurred:

    - First, the idea for committing the crime came from the government agents and not from the person accused of the crime.

    - Second, the government agents then persuaded or talked the person into committing the crime. Simply giving him the opportunity to commit the crime is not the same as persuading him to commit the crime.

    - And third, the person was not ready and willing to commit the crime before the government agents spoke with him.

    On the issue of entrapment the government must prove beyond a reasonable doubt that the defendant was not entrapped by government agents.

    So Basti, by the established legal definition, what occurred at the Florida mall most likely cannot be found to fall under the legal definition of entrapment.

    Carl, you don’t KNOW Basti, he is NEVER wrong, even when he is, and in this case, he is VERY wrong, he has NO knowledge of the law apparently and has let his ignorance and hard head dictate the responses seen in this thread…

    I have overlooked several things similar to this in the past, simply because I felt like Basti was one hell of a good guy overall and I considered him to be an online friend, but he will NEVER admit to being wrong, about ANY THING, no matter what it is, no matter how insignificant or important it may be, he is NEVER wrong in HIS opinion…

    Well, I will say this, and I don’t give a DAMN who it offends, ANYONE that sides with the pedos and pervs is MY enemy, just as much as the pedos and pervs are my enemy, and that bullshit about entrapment is siding WITH the sorry bastards and only makes the person doing it as scummy as the pervs themselves…

    In my LE career I’ve had a few suspects bring up an entrapment defense, mostly in drug cases were we had video of suspects selling drugs to other suspects. It never worked (except the lawyers getting paid). They all went to jail.

    Aside from the fact that the law will vary (potentially) widely, As Carl stated above (in a few more words), entrapment is the inducement by police, of a person to commit a crime that the person otherwise would not have committed.

    Almost all criminal offenses require intent, if the intent is formed by the police then the suspect has a defense.

    Outside of the movies, in the real world, entrapment is not a common occurrence. If for no other reason than in most jurisdictions police officers that get cases thrown out for such things don’t get to do their jobs for long. Most cops are smart enough to effect an arrest without having to induce the suspect to commit the crime. In my experience there is no shortage of willing criminals.

    Although I don’t know the facts of this particular case it’s hard to imagine a “loud zipper sound” being evidence. I’m sure the police have established some basis for that though. I still don’t know one would even do that.
