WASHINGTON (AP) – The Supreme Court said Tuesday it will decide whether the District of Columbia can ban handguns, a case that could produce the most in-depth examination of the constitutional right to ‘keep and bear arms’ in nearly 70 years.
The justices decision to hear the case could make the divisive debate over guns an issue in the 2008 presidential and congressional elections.
City officials said the law is designed to reduce gun violence, noting that four out of every five homicides this year was committed with a gun. Opponents of the ban pointed to the level of violence to make their case that Washington residents should be allowed to have guns to protect themselves in their homes.
“This is clearly going to be one of the biggest cases decided this year,” said Georgetown University law professor Randy Barnett. “It is one of the very few times when the Supreme Court has the opportunity to interpret a provision of the Constitution unencumbered by previous Supreme Court rulings.”
The government of Washington, D.C., is asking the court to uphold its 31-year ban on handgun ownership in the face of a federal appeals court ruling that struck down the ban as incompatible with the Second Amendment. Tuesday’s announcement was widely expected, especially after both the District and the man who challenged the handgun ban asked for the high court review.
The main issue before the justices is whether the Second Amendment protects an individuals right to own guns or instead merely sets forth the collective right of states to maintain militias. The former interpretation would permit fewer restrictions on gun ownership.

Alan Gura, a lawyer for Washington residents who challenged the ban, said he was pleased that the justices were considering the case.
Guns be regulated but not banned, Gura said. “This isn’t going to let crazy people have guns or felons have guns,” he said at a news conference outside the court.
Yes, it can be a good thing, having the SCOTUS write a decision on this, IF it goes the RIGHT way, but this Gura guy is an IDIOT, and I do NOT bite my words when I say that, Gura said, “This isn’t going to let crazy people have guns or felons have guns,” and to that I say bullshit, crazies and felons have as many guns as anyone else, and legality has NOTHING to do with it, if a person wants a gun and can’t acquire it through legal channels they will get one in some other manner, and believe me when I say this, crooks, robbers, muggers, rapists, burglars and all other assorted vermin don’t go to Joe’s Gun and Tackle to buy a gun, they wait until after hours, they break in, do a snatch and grab and haul ass before the cops get there, and until one of the guns is found on some thug walking the street or it turns up as evidence in some court case, that’s the end of it.
The bad guys don’t get their guns legally and they don’t carry registered guns, at least not registered to them, the excuses used by the anti-gun crowd of ‘If all the guns were gone, all the crime would be too’ is, without a doubt, the most insidious statement that can be made, there is NO WAY to gather up ALL the guns, and even if you did, there’s still knives, spears, hammers, sling shots, archery, any number of ways to commit deadly acts of violence upon your fellow man, but there will ALWAYS be guns, it’s simply a matter of WHO will have the guns.
Republican presidential candidate Rudy Giuliani, who as New York mayor sued the gun industry for letting criminals get guns, said in a recent interview with The Associated Press that the case “is a very, very strong description of how important personal liberties are in this country and how we have to respect them.”
Giuliani now says the Second Amendment gives citizens the right to own handguns and is not, as he previously argued, limited to the rights of states to maintain citizen militias.
And again I say, Giuliani is a far left gun grabbing moonbat trying to convince everyone that he’s a Conservative Republican just so he can get elected, look folks, the guy has already changed his stance on the gun issue once, who’s to say that IF he were to be elected POTUS that he wouldn’t once again change his stripes and issue an executive order this time, it CAN happen.
Beware the RINOs, ALL of the RINOs, and if you have any ‘cold’ weapons, hide em, you may need them a lot sooner than you ever imagined, and if I have to explain ‘cold’ to you, it’s not worth my time.

As you say, the thieves and nuts have no problems finding guns. Gun laws only serve to make a criminal out of an otherwise honest citizen.
I will NEVER, as long as there is a breath left in me, surrender my weapons.
I will never forget being held with a loaded gun in my face and wishing to God I had kept mine in my purse then.
