Does Obama Violate the Hatch Act with Acceptance of Nobel?

The Hatch Act restricts the political activity of executive branch employees of the federal government, District of Columbia government and some state and local employees who work in connection with federally funded programs. In 1993, Congress passed legislation that significantly amended the Hatch Act as it applies to federal and D.C. employees (5 U.S.C. §§ 7321-7326). (These amendments did not change the provisions that apply to state and local employees. 5 U.S.C. §§ 1501- 1508.) Under the amendments most federal and D.C. employees are now permitted to take an active part in political management and political campaigns. A small group of federal employees are subject to greater restrictions and continue to be prohibited from engaging in partisan political management and partisan political campaigns.

Penalties for Violating the Hatch Act

An employee who violates the Hatch Act shall be removed from their position, and funds appropriated for the position from which removed thereafter may not be used to pay the employee or individual. However, if the Merit Systems Protection Board finds by unanimous vote that the violation does not warrant removal, a penalty of not less than 30 days’ suspension without pay shall be imposed by direction of the Board.

Could this spell some seriously unwanted legal ramifications for the Obama Administration? I would hope so. Even if it meant having Joe Biden standing in Obama’s place. Former Ambassador John Bolton offers some fascinating tidbits in the YouTube video as well.

If that were to happen, I would offer Biden this one little bit of advice, Nancy Pelosi will stop at NOTHING if it means she could possibly become President of the United States.  Just sayin’…

    Wow… I this is interesting. The Nobel Moonbat Prize committee have never gave the “Prize” to a sitting moonbat POTUS???

    There are those who believe the Nobel Committee did this to discourage Obama from deploying the requested troops to Afghanistan and to keep Obama from acting on Iran. Heaven help him if he caves, this situation could have some real teeth.

    Well, I don’t know ALL of the ramifications, implications or anything else, I am NOT a lawyer, but the idea is intriguing, the very idea of Obama and High Crimes is outstanding…

    And High Crimes has nothing to do with him getting that way… :twisted:

    Dayyum….I learn something every time I come snooping around these parts. :D

    So, if the Hatch Act applies, that means that Carter would have to return his too? Wilson and Roosevelt got theirs before the Act, so they don’t count…not to mention they are both as dead as door nails.

    Oh yeah, it’s because the folks who voted him the prize dislike America as much as N-Obama does! They loved the apology tour and are rewarding him for it. Yeah! That must be it. I’m sure of it now.

    Unusual idea-the Hatch Act. Well I’m not waiting for that egg to “hatch”. Can anyone see Eric Holder going forward, or the House with Nancy at the helm. Heck, this guy could shoot his dog and even the ASPCA wouldn’t lift a finger. Him getting the Nobel prize is a joke, but then the Norwegians are a joke. This is the only play they have on the international stage. Each year the importance of the Nobel Prize goes down in the eyes of the common man here in American. Its the MSM that gives it status. Just like the pultizers they are both political now days with the left controling who is honored.

    The Hatch Act would not apply.

    However, he is limited by the constitution. At present: All gifts to the President from foreign governments belong to the U.S. government. [But then the award is from a private org and not a government.]

    Also there is US CODE: Title 5,7342. dealing with gifts

    However, the President may accept gifts from private citizens, but gifts in excess of a certain amount must be disclosed.

    The Nobel Peace Prize includes a medal, a personal diploma, and a large sum of prize money (currently 10 million Swedish crowns). A Norwegian award given in Swedish money - interesting. Tonight Conversion rate 1 Swedish krona = 0.14257 U.S. dollars. [$1,425,700]

    I believe if Obama is allowed to donate the money it should be donated to US - the good old United States - Treasury.

    But Obama will use it to buy more influence. Do you suppose he would finally give a few dollars to his poor African grandmother and brother and Asian sister?

    B. Hussein is the third sitting president to receive this award. So there is precedent. I’m not saying it’s right he got it, just that it’s not the first time. Seriously, after they gave it to Arafat, it shouldn’t have surprised anyone if they had given it posthumously to Stalin.

    Just think? That prize money will probably be less than it will cost to fly him, his entourage, and security to pick it up.

    I wonder what charity he will donate the money to? I wonder if it will wind up with ACORN?

    Actually 2 sitting POTUS have won it. Wilson and Teddy Roosevelt. Both ended wars. Obama got it because he is black and not George W. Bush.

    As long as he gives the money away, he can keep the award. That will be the most money either of them have ever donated to any charity.

    NOMINATION FOR THE NEXT DOUCHEBAG OF THE WEEK: The awarding committee for the Nobel Peace Prize and the nation of Norway! Why did we ever save their sorry assess from the Germans????????????

    I was wondering whether it was constitutional for Obama to accept the prize money also. Section 9 of the constitution:

    No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince or foreign State.

    It certainly seems that the prize money could be considered an emolument from a foreign state.

    What a day yesterday was for President Barack Obama!

    At 0600 the Pentagon awarded our Nobel Peace Prize winner the Navy Cross, the Army Distinguished Service Cross and the Air Force Cross.

    At 0615 he was also awarded the Medal of Honor.
    At 0630 he was awarded a Silver Star

    And at 0645 he was awarded a Purple Heart.

    At 7:00 am he was awarded all of Michael Phelps’ Olympic Gold Medals for swimming.

    At 8:15 am he was named MVP for next year’s Super Bowl.

    At 9:00 am he was inducted into the Rock & Roll Hall of Fame.

    At 9:45 am he received word that he’d won a Pulitzer for next year.

    At 10:00 am he received an Academy Award for next year.

    At 10:30 he received a Peabody Award for next year
    .
    At 11:15 am he received a Grammy for next year.

    And at 12:30 pm he received a People’s Choice Award for next year.

    At 1:30 pm he was named 2010 Playmate of the Year by Hugh Hefner.

    At 2:00 pm he landed the lead role in the 2010 remake of “Jesus Christ Superstar.”
    At 2:45 pm he was declared the winner of next year’s Masters golf tournament.

    At 3:30 pm he was declared the winner of next year’s Kentucky Derby.

    At 4:15 pm he was declared the winner of next year’s U.S. Open tennis tournament.

    At 4:45 pm he was declared the winner of next year’s National Spelling Bee.

    At 5:30 pm he cured cancer.

    At 7:00 pm he walked across the Potomac River to grab a bite to eat.

    At 11:00 pm the angels tucked him in and kissed him gently on his forehead.

    Fortunately, today is Sunday and The Chosen One can rest.
