The Dissection of the Obama Gun Safety Proposal

The Dissection of the Obama Gun Safety Proposal
This is the list of Obama/Biden gun law changes and proposals as I have it. I am going to address each one of these items. I am NOT the final word on this and my ideas may differ from yours, but for now; these are MY responses.

1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.

TF response: The background checks need to include ALL relevant information, any record of psychiatric treatment and its result being 1st and foremost. A criminal background check is also a much needed check but the fact of the matter is this; criminals don’t BUY guns through LEGAL sources.

2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.

TF Response: The administration will develop regulations for the Affordable Care Act (Obamacare) aimed at ensuring comprehensive care for mental health problems. This would include putting money toward new social workers and psychologists. Read MORE TAXES.

3. Improve incentives for states to share information with the background check system.

TF Response: The old NCIC system worked well for Police information many years ago, it shouldn’t present too much of a problem to build a *shared* database allowing states to access information from other states regarding background checks and their result.

4. Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.

TF Response: Directing the Attorney General to do ANYTHING about guns is a lot like handing a teenage boy the car keys and a bottle of whiskey. Fast and Furious anyone?

5. Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.

TF Response: If Law Enforcement isn’t already running a background check on an individual BEFORE returning a *seized gun*, I would be totally shocked. That only seems like COMMON SENSE to me. YOU gave the Police a reason to *seize* your gun, they need to ascertain that YOU are justified in having it back.

6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.

TF Response: There will be NO WAY to regulate the sale or transfer of privately owned arms between private individuals.

7. Launch a national safe and responsible gun ownership campaign.

TF Response: Uh, isn’t that exactly what the National Rifle Association does?

8. Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).

TF Response: A gun with a GUN LOCK is NOT a gun, it is an expensive club! If you own enough guns that you need a gun safe to store them or secure them, and said gun safe is locked, I hope you never need one of those guns in a hurry.

9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.

TF Response: I thought that was already being done?

10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.

TF Response: Again, a common sense measure, one that responsible guns owners should already observe. I have recorded serial numbers of my weapons stored in safe places and I have insurance to cover ANY gun losses. Do we need a Presidential order to enforce what should be a *common sense* measure for ALL gun owners?

11. Nominate an ATF director.

TF Response: WHY hasn’t this already been addressed? What is it now, 6 years since there was a Director? More importantly; would having an OFFICIAL Director have stopped ANY gun crime or senseless act of gun violence?

12. Provide law enforcement, first responders, and school officials with proper training for active shooter situations.

TF Response: There is only ONE WAY to address an active shooter situation; you engage that shooter and you stay engaged with him until the situation has come under control. That means you train our educators in the proper use of a handgun, train them in the proper way to engage an active shooter and let them do the job they have been trained to do, SHOOT THE SON OF A BITCH DEAD!

13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime.

TF Response: Is Obama saying that our Law Enforcement Officers and the judicial system aren’t giving their *maximum effort* already?

14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.

TF Response: This is the most incredibly stupid proposal in this list so far. We’re not talking about West Nile Virus, the CDC needs to stick to disease, NOT crime and the sanity of a few mentally unbalanced individuals.

15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies.

TF Response: I have to ask; wouldn’t Eric Holder need to invoke the Fifth Amendment on this one? Fast and Furious folks…

16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.

TF Response: Do you remember *Don’t Ask, Don’t Tell*? Well, it’s none of my doctors business whether I own a gun. I am NOT telling.

17. Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.

TF Response: I believe that ANY doctor/patient privacy issue goes right out the window when the patient tells the doctor, “Sometimes I just want to kill people”. Someone has to take the responsibility of making Law Enforcement aware that there is a potential mass murderer out there. Several recent shootings, Va. Tech comes to mind, also the Aurora theater shooting, where the shooter HAD voiced his thoughts and plans and the doctor did little if anything to affect a notification.

18. Provide incentives for schools to hire school resource officers.

TF Response: An admirable offering, WHO will pay for it?

19. Develop model emergency response plans for schools, houses of worship and institutions of higher education.

TF Response: Again, a common sense issue that is already in place in MANY schools, offices and places of worship. You can’t legislate COMMON SENSE.

20. Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.

TF Response: To what point? Is that going to make any of us safer? Will it do anything to take guns out of the hands of criminals or the insane?

21. Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.

TF Response: See previous response.

22. Commit to finalizing mental health parity regulations.

TF Response: Mental health is a slippery slope. If a person is mentally unbalanced but has not been adjudicated as such, how would a LEGAL gun sales person have any way of knowing that the buyer was not a sane person unless said buyer were exhibiting actions that could be defined as unmistakable signs of insanity? Does the Obama administration propose placing a psychologist in ALL gun stores?

23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.

TF Response: Maybe it’s just me but I am seeing this discussion on mental health going sideways as the Obama administration tries to find a way to label ALL gun owners as some sort of mentally deficient person.

In conclusion; Barack Obama made a speech, Joe Biden and some Libber staff came up with a list of 23 FEEL GOOD proposals that don’t amount to a hill of beans.

We already have MORE than enough guns laws; at least half of this proposed list is a waste of time, money and effort or is already in place. Enforce the gun laws we already have, enforce them honestly and fairly, that’s all it will take America.

I hope that ALL GOP Senators and Congress members, and at least *some* of the Dems see this list from Obama for exactly what it is; something to pacify the (m)asses and give a warning to the Senate and House that he (Obama) will attempt Executive Orders if this were to fail.

And fail it will.

  1. Robert says:

The only agreement I can reach on this issue is background checks. What exactly is the benefit to ME the legal gun owner to purchase a firearm legally? I get my background checked and I can then lock my firearm in a case? NO. Lets allow background checks, but lets reward the people who go through it and make that their CCW permit. IF you passed this and it’s supposed to protect the children, lets allow those who pass it to truly protect the children.

I’m too pissed off to post further Fred.. Maybe later

    • Patrick Sperry says:

So giving a gift to your grandson for example, and going through a background check is GTG with you? Respectfully Robert, I will disagree. Nor will I comply with such rubbish.

  2. Hgpsurf says:

Don’t hand any more power over us to Eric Holder. He is Liar in Chief, Jr. and is about as anti-gun as they come. I fear he & Obama will figure out a way to deny us ALL in the background checks.

  3. mrchuck says:

Barry Soetero, the pontificator, make his 2013 “Broadway” show, and I watched and listened.
What crap. Our Congress WILL NOT PASS THIS!
Since Barry made up these other names, and never ever had them registered, just made them up in an” epiphany”, he had smoking dope, along with making up his “background”, I still cannot personally respect what he really is and what the puppet does.
I do respect the “Office of the Presidency”.
    So, what will I do?
    1. have written my congressman and informed him of my thoughts and desires.
    2. same for my US Senator, and Governor of my State.
Today, was a “dog and pony” equivalent to the one’s of Hitler!!!
Reader’s be aware of all the propagandists Barry has in his cabal in D.C.
I expect 100% that “John the Boner”, Speaker of the House in Congress, will have a message for all of us patriots.
I will be attending a “gun show” in Tyler, TX this weekend.

  4. Bunkerville says:

It will be under the guise of mental health that they will deny our guns. Just watch this one play out. 30 percent of the population has at one time seeked help. No doubt a board will be formed to determine ones fitness.

  5. Patrick Sperry says:

As noted, most is already being done. An ATF Director? Why, so more innocent Americans can get killed by guns that Los Federales send across the border with the sole intent of more gun control? Mental health? Okay, but just who get’s to define that? Will there be even more ex post facto law? Hell, stop for a second and think of all the various implications in this missive that trash the Bill of Rights, and not just the Second Amendment. Slippery slope..? Here is a “slippery slope” for you. The term “Law abiding citizen.” With the stroke of a pen everyone here could be declared a felon. Without recourse I might add.
The dipshit in chief even mentioned outlawing armor piercing ammunition in his speech. Guess what you Tory toad, it is, and has been for years!

More later on I am too pissed to post!

  6. TexasFred says:

    From my Senator, Ted Cruz…

It’s sad to see the President of the United States trying to exploit the tragic murder of children as an excuse to push his own extreme anti-gun agenda.

None of these proposals would have stopped the massacre at Newtown, but they would restrict the constitutional rights of every American. We should use every available means to deter and to punish mass murderers, but the federal government should not be trying to ban gun ownership for law-abiding Americans.

The Second Amendment is a fundamental part of the Bill of Rights-the ‘palladium of the liberties of a republic,’ as Justice Joseph Story put it-and I intend to help lead the fight in the U.S. Senate to preserve our individual right to keep and bear arms.

  7. Bloviating Zeppelin says:

These EXECUTIVE ORDERS — not “measures” or “actions” or a “package” -

    - Also, essentially, make doctors and health officials Mandatory Reporters if they may possibly believe there is a hint of a verbal threat of violence perceived or remotely implied during a medical visit.

Doctors will now be talking to you about firearms safety, as part of the Mandated Reporter chain.

Logically — I extrapolate — you can bet that the insurance for doctors will go up, necessitating additional healthcare costs passed on to the consumer, as doctors face greater risk exposure for not reporting incidents — judged in hindsight.

    You can BANK on it.

  8. BobF says:

By gosh Fred, you may not be the final authority but your darn close to it.

Just a couple of additional comments to complement your responses to a few numbered items.

    2…BINGO, more taxes
4…Your assessment of Holder got me LOL
6…The only way to regulate private sales or transfers is to have all guns registered. When I was stationed in Michigan, all handguns had to be registered and therefore all private sales required a background check and permit. Procedure: Apply for permit at police station; go back in three days to pick up permit; take permit to seller; seller keeps bottom half of permit as receipt of sale; take handgun and permit back to police station; turnover gun and permit to police; go back to police station to pick up gun once serial numbers have been cleared Michigan State Police which usually took at least 3 days.
7….Exactly and the NRA does it at no cost to the taxpayers.
    13…Like everything Fred; it’s someone else’s fault.
14….The CDC reported that 23,000 women and girls die annually from binge drinking. I wonder why he doesn’t have Biden look into that?
16…Obamacare already prohibits that. He would have to change his own law.
19…Many churches already have members who are armed and trained within the congregation and watching out over the flock. Remember, Jesus’ last command to his disciples was for them to sell their coats, if necessary, and buy a sword, the most lethal weapon a man could hold during his time on earth.

Statement by Gov. Perry on President Obama’s Executive Actions

    January 16, 2013

Gov. Rick Perry released the following statement regarding President Obama’s executive actions:

“The Vice President’s committee was appointed in response to the tragedy at Newtown, but very few of his recommendations have anything to do with what happened there.

“Guns require a finger to pull the trigger. The sad young man who did that in Newtown was clearly haunted by demons and no gun law could have saved the children in Sandy Hook Elementary from his terror.

“There is evil prowling in the world - it shows up in our movies, video games and online fascinations, and finds its way into vulnerable hearts and minds. As a free people, let us choose what kind of people we will be. Laws, the only redoubt of secularism, will not suffice. Let us all return to our places of worship and pray for help. Above all, let us pray for our children.

“In fact, the piling on by the political left, and their cohorts in the media, to use the massacre of little children to advance a pre-existing political agenda that would not have saved those children, disgusts me, personally. The second amendment to the Constitution is a basic right of free people and cannot be nor will it be abridged by the executive power of this or any other president.”

    Texans for Rick Perry

  10. Chief says:

First and foremost. get gun control OUT OF HEALTH CARE PERIOD.
Wait, we have to repeal the affordable health care act first. or at least overhaul it.
Maybe it’s just wishful thinking since our elected officials do nothing but bow to the King and do nothing to stop him.
If I say anything more I might just land in jail… since free speech is now controled by the gubbermin.

  11. Katie says:

The former Soviet Union used Psychology and Mental Illness to lock away many dissidents. This is a very slippery slope to go down. It is no wonder so many Vets swallow their guns. Just to talk to a doctor at the VA about mental issues and they lose their right to own a gun.

The madman in Newtown entered a supposedly locked down school by breaking a window on a door and walking in. But for shatterproof glass 26 are dead. It is cruel to say so, but it is the truth Fred. If that door had been shatterproof those children would be alive today.

    • TexasFred says:

Don’t forget, *BAN ASSAULT RIFLES* too…

That type of rifle and the magazines were already banned in Connecticut if I understand correctly…

Stronger gun bans and shatterproof glass… That’ll do it…

      • Katie says:

An M-16 is an assault rifle. An AR-15 isn’t. They look mean and nasty but act differently. The media believes if a gun looks “military” then it is “dangerous” and must be eliminated.

Funny thing is that the AR-15 will not be banned under an Assault Weapons Ban.

  12. Bloviating Zeppelin says:

What no one seems to understand or remember:

The genetic mutant from Newtown went to a gun store to acquire another weapon and was REFUSED.

Hello?? The system in place ALREADY WORKS!

  13. mrchuck says:

    Wonderful Reply BZ!!!!
This is something that the socialist responders did NOT want known!!!
All this hoopla is a ploy for Socialist gun grabbing laws, to make it easier for”them” to overthrow our Constitution, and then turn the USA into the hands of socialist politicians!!

  14. Longstreet says:

All 23 — complete bovine scatology! Get the insane off the streets and back behind walls away from the rest of us.

    JDL

  15. minuteman26 says:

Will not comply with any changes to gun laws as written as of 1Jan 2013. If that makes me a felon in the future, so be it.

  16. LD Jackson says:

Good roundup of the orders and great response to all of them. Basically, they are nothing but a bunch of feel-good statements. Some of them are common sense that should already be in place, but some of them are complete and total nonsense.
