Justices extend gun owner rights nationwide

WASHINGTON (AP) - The Supreme Court held Monday that the Constitution’s Second Amendment restrains government’s ability to significantly limit “the right to keep and bear arms,” advancing a recent trend by the John Roberts-led bench to embrace gun rights.

By a narrow, 5-4 vote, the justices also signaled, however, that some limitations on the right could survive legal challenges.

Writing for the court in a case involving restrictive laws in Chicago and one of its suburbs, Justice Samuel Alito said that the Second Amendment right “applies equally to the federal government and the states.”

The court was split along familiar ideological lines, with five conservative-moderate justices in favor of gun rights and four liberals opposed. Chief Justice Roberts voted with the majority.

Two years ago, the court declared that the Second Amendment protects an individual’s right to possess guns, at least for purposes of self-defense in the home.

I am, have always been, and will continue to be a supporter of the Second Amendment, I will be that supporter until the day I die. That will be the day they can have MY guns, the day I die. Not one day sooner!

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

What part of that is so hard for LIBERAL law makers and bleeding heart gun grabbers to fully understand?

Militia – noun
1. a body of citizens enrolled for military service, and called out periodically for drill but serving full time only in emergencies.
2. a body of citizen soldiers as distinguished from professional soldiers.
3. all able-bodied males considered by law eligible for military service.
4. a body of citizens organized in a paramilitary group and typically regarding themselves as defenders of individual rights against the presumed interference of the federal government.

We, The People, we ARE that militia!

We all know that the military is supposed to be the protector of the land, but let me pose this to my readers; what happens when the military isn’t enough? What happens when the military is led by a Commander in Chief that is NOT an American? A CiC that has but one desire in his heart? That desire being the total destruction of the USA as we know it? A CiC that isn’t adverse to destroying the United States military if that’s what it takes to fulfill HIS dream?

An armed American is also a defender of THIS nation. We are the back-up to the U.S. military, and we are the last line of defense against an oppressive regime, one much similar to what we now see in the White House.

If this nation were to be attacked with nuclear weapons, a militia is a moot point until AFTER the attack. A militia will be the survivors, and once we can see what’s left of this nation and our military, make NO mistake, We, The People, would once again be called upon to defend what is ours and what this nation stands for!

Do you know why the United States wasn’t invaded during WWII? It actually had very little to do with our military capabilities.

Our enemies fear us, you and me, the American gun owner, more than they fear our military.

Thank God we have a Conservative Supreme Court majority. Pray that Barack Hussein Obama doesn’t get a chance to destroy it before his reign is over.

    When people fear the government there is tyranny. When government fears the people there is freedom. The tyrant fears weapons in the hands of free men and women.

    Thank GOD they decided that right. BUT I’m one of those look behind the ruling kind of guys. ( I posted the full PDF of the opinion you can download at my site) What I noticed is the court didn’t decide the Chicago ban finally, it left it open for the district court to review on remand.

    I also see that our newest SCOTUS judge decided with the minority even after her question/answer session at which she answered YES to the “Americans have the RIGHT to bear arms” question….So Kagen can be taken a face value today?

    We are ONE Judge away from a total ban on our freedoms, we are one Obama appointment from civil war if they ever decide our 2nd amendment right is no longer law….

    Great post here Fred….I especially like the Yamamoto quote…..and he was right…more importantly the Supreme Court has upheld our Constitution…which they should do in every case regardless of their own personal leanings…

    But isn’t it, Fred, one helluva comment that we should even have to WORRY about ANY abridgement of our Second?

    And Robert is correct; Kagan will put the opposite camp clearly over the top. You can be sure that your basic freedoms guaranteed by the Bill of Rights and the Constitution WILL be eroded by the New Supreme Court.

    As in Haller v. DC, the good news is they decided it correctly. The bad news is that we are one vote on the SCOTUS from tyranny.

    The movie Red Dawn is a good example of the militia. Something else to remember about that movie. When the USAF Colonel explained to the Wolverines (militia) about how the attack happened, he stated it was Illegal Aliens who caused disruptions at military installations, particularly USAF bases, that allowed the invasion to take place. About two years ago, a number of Illegal Aliens were caught working construction projects on Whiteman AFB, home of the B-2 Stealth Bomber. What happened in that movie is very possible since we wouldn’t use nukes upon our own cities and towns.

    That’s a great creed Fred. Every gun owner in America should repeat that with his hand on the Bible and live up to it.

    YES. They went for the federal forms to discover who owned weapons.

    As in Cuba.

    This was ahuge victory for the second amendment, I just wish the SC had over-ruled the handgun ban. They sent it back to the lower courts to decide.
    We can expect to see more lawsuits in the future based on this ruling and I expect more regulations to be overturned. We must not forget that this decision was only 5-4, after Kagan we have to hope that Obama has no more SC nominees.

    BZ, that’s true and I forgot about that part. Another thing to think about is that the government got hold of the NRA membership list, they would have the names and addresses of almost 4 million gun owners.

    As usual though, the black robed pussies CAN’T come right out
    and say,… God dammit, their rights shall not be infringed, and that means exactly what it means. Screw the lower courts. We ARE the Supreme Court, the highest court in the land and there is not going to be ANY shit for brains lower court try and side step what we just decreed and that’s the end of it period!! It’s over, it’s done, it’s NOW the law.
    Don’t like guns??
    Feel free to move to Australia or anywhere else.
    chicago, will somehow get the lower courts to ban the right to carry you can bet on it.
    Watch and see If I am not right.
