Veterans are receiving letters from Obama administration prohibiting the ownership of firearms
Written By Constitutional Attorney Michael Connelly, J.D.
How would you feel if you received a letter from the U.S. Government informing you that because of a physical or mental condition that the government says you have it is proposing to rule that you are incompetent to handle your own financial affairs? Suppose that letter also stated that the government is going to appoint a stranger to handle your affairs for you at your expense? That would certainly be scary enough but it gets worse.
What if that letter also stated: “A determination of incompetency will prohibit you from purchasing, possessing, receiving, or transporting a firearm or ammunition. If you knowingly violate any of these prohibitions, you may be fined, imprisoned, or both pursuant to the Brady Handgun Violence Prevention Act, Pub.L.No. 103-159, as implemented at 18, United States Code 924(a)(2).”?
That makes is sound like something right from a documentary on a tyrannical dictatorship somewhere in the world. Yet, as I write this I have a copy of such a letter right in front of me. It is being sent by the U.S. Department of Veterans Affairs to hundreds, perhaps thousands, of America’s heroes. In my capacity as Executive Director of the United States Justice Foundation (USJF) I have been contacted by some of these veterans and the stories I am getting are appalling.
The letter provides no specifics on the reasons for the proposed finding of incompetency; just that is based on a determination by someone in the VA. In every state in the United States no one can be declared incompetent to administer their own affairs without due process of law and that usually requires a judicial hearing with evidence being offered to prove to a judge that the person is indeed incompetent. This is a requirement of the Fifth Amendment to the U.S. Constitution that states that no person shall “… be deprived of life, liberty, or property without due process of law…”.
Obviously, the Department of Veterans Affairs can’t be bothered by such impediments as the Constitution, particularly since they are clearly pushing to fulfill one of Obama’s main goals, the disarming of the American people. Janet Napolitano has already warned law enforcement that some of the most dangerous among us are America’s heroes, our veterans, and now according to this letter from the VA they can be prohibited from buying or even possessing a firearm because of a physical or mental disability.
Think about it, the men and women who have laid their lives on the line to defend us and our Constitution are now having their own Constitutional rights denied. There are no clear criteria for the VA to declare a veteran incompetent. It can be the loss of a limb in combat, a head injury, a diagnosis of PTSD, or even a soldier just telling someone at the VA that he or she is depressed over the loss of a buddy in combat. In none of these situations has the person been found to be a danger to themselves or others. If that was the case than all of the Americans who have suffered from PTSD following the loss of a loved one or from being in a car accident would also have to be disqualified from owning firearms. It would also mean that everyone who has ever been depressed for any reason should be disarmed. In fact, many of the veterans being deprived of their rights have no idea why it is happening.
The answer seems to be it is simply because they are veterans. At the USJF we intend to find the truth by filing a Freedom of Information Act request to the Department of Veterans Affairs to force them to disclose the criteria they are using to place veterans on the background check list that keeps them from exercising their Second Amendment rights. Then we will take whatever legal steps are necessary to protect our American warriors.
The reality is that Obama will not get all of the gun control measures he wants through Congress, and they wouldn’t be enough for him anyway. He wants a totally disarmed America so there will be no resistance to his plans to rob us of our nation. That means we have to ask who will be next. If you are receiving a Social Security check will you get one of these letters? Will the government declare that you are incompetent because of your age and therefore banned from firearm ownership. It certainly fits in with the philosophy and plans of the Obama administration. It is also certain that our military veterans don’t deserve this and neither do any other Americans.

Has ANYONE seen any actual PROOF of this? Have you received or seen the supposed letter? Does anyone have a copy of this letter, one that can be copied, attached and emailed?
Or is this another one of those Internet Alarmists I believe are tainting the information that we so desperately need?
I don’t want you to tell me you *heard* about it, I heard about it, I want to tell me you have it and I want to see it, from reliable folks that have received this letter.
If anyone can send me irrefutable PROOF of this letter, ie: a COPY of the letter, I will post it and be going off all over it with MY U.S. Senators and Congressman. No links to some STORY on the ‘net, the actual letter, THAT is the only irrefutable proof that will be accepted.
I’ll look forward to seeing what becomes of USJF’s FOIA request.
Keep your powder dry
I have not heard of any vet in my area receiving any letter..If I do I will let you know.
This is something we should investigate and report, if it’s the truth. I have heard of no one receiving a letter such as this.
No one else has either…
Some MORON on Facebook tried to tell me that he KNEW it was real, he has a friend that has a friend that got denied a CHL because he was a Vet…
Yeah, OK, whatever… SHOW ME THE LETTER..
No one has a copy of the letter, all they have is a post from a guy and we ALL know, ya can’t put it on the ‘net f it’s not true.. Right??
OK, until someone can come forth and show us the actual letter I am calling BULLSHIT on this story…
It’s like the age-old conundrum: PROVE you’re not insane by someone else’s definition of insanity.
Because, after all, if this “letter” exists for the military, then how long before it’s applied to the civilian strata?
Finally: who watches the watchers?

Have YOU seen this letter or is your comment based solely on the story?
No sir, I have not seen the letter; I’m hypothesizing.
BZ
OK.. I am being flooded with link after link from people I never heard of and they ALL link back to this Lawyer and offer NOTHING but his words… No proof that the letters actually exist.. .
But you guessed it, TexasFred is an ASSHOLE because HE didn’t take a LAWYER at his word.. LMFAO
Heavy sigh.

In the meantime they are rounding up the mentally ill as defined by a beat cop in NYC. No due process required. The care and treatment if what should happen to these poor souls is for another day. The point is the precedent is being set.
I don’t know if this is true or not but I wouldn’t be surprised if it is. In fact I would be more surprised if it weren’t true.
I haven’t heard of this before now. And I get a lot of letters from the VA. But this is a reason many vets will not seek help. They know the minute they reach out, they lose their 2nd Amendment rights. So they go untreated.
I wouldn’t put it pass Obama and his regime, but until I see one of the letters I will consider it an Urban Legend.
KEEP YOUR POWDER DRY!!!
Fred: I haven’t seen the letter, either. However, this morning on Drudge, (02-22-13) there is a link to Gateway Pundit where they purport to show a portion of page two of the letter from the VA with that portion concerning gun ownership being denied. But — That is ALL I have seen. I checked the VA site last night and nothing was mentioned on it — that I could find, anyway.
JDL
Went to Gateway’s comments. I thought one of the best was…”have McCain, Kerry, and Hagel received this notice? Have they been evaluated for PTSD? Have they ever had a legal prescription for Xanax or similar?”
Am I thinking or am I looking for Tweedledum and Tweedledee to lead our nation?
Hope this is not construed as being negative or criticizing vets, I being one.
Haven’t actually seen it, but GOA has been all over the issue for years. If it would in fact have unfolded, I think we would have been told about it.
WND posted a copy of the alleged letter.. can be downloaded in pdf format.
Having read it… I think the letter was created by the same folks who created Ogabe’s Birth Certificate..
It looks official however, since when has the VA cared how I handle my money? If I give it all to some hooker… it’s none of their business.
It’s just scare tactics being created to aid the anti-gun nuts.
IMHO.. or my .02 cents
Agreed.. No one seems to be able to come forth with a copy that is in their possession… The ‘net is a wonderful tool but when a BS story starts making the rounds it grows like wild fire, with everyone linking this blog, that blog and some other blog and crying because no one will buy it…
But I saw it on the ‘net, it MUST be true…
Dumbasses…
Here is another link, Fred, on Before It’s News. There is an alleged reproduction of a letter.
I still find myself wary. . .
BZ
Before it’s News is a link, but not really.. They are a syndication service, nothing more… They don’t write anything, if you’re registered with them, when you post, they pick up your feed and re-post it…
One of those things I was telling you and Brady about as a way to get more hits…
I’m just impressed that the VA managed (allegedly) to send letters to the correct addresses. That’s a huge accomplishment for them.
