Another Win for Arpaio: Immigration Activists Lose Court Battle
PHOENIX, AZ – After several months under consideration, Federal Judge Susan Bolton this week ruled in favor of Maricopa County Sheriff Joe Arpaio and the County Attorney’s Office in a hotly contested matter about whether illegal immigrants, who were arrested on felony charges, should be able to post bond and get out of jail.
In 2006, Arizona voters approved Proposition 100 which precluded bail to arrestees who entered or remained in the state illegally and who were charged with serious felony offenses.
When Sheriff Joseph Arpaio, in conjunction with the Maricopa County Attorney’s Office, developed policies and procedures to implement the new law, two National Law Firms and the National ACLU Representatives sued the Sheriff and County Attorney to stop them from enforcing it.
The ACLU claimed Prop 100 was unconstitutional on its face, excessively harsh in how it was being enforced and a violation of the illegal alien arrestee’s due process, and 5th, 6th, and 8th Amendment Rights.

What applied in 1883 does NOT apply today.
By it’s very definition, ILLEGAL means *AGAINST THE LAW*, there is no other definition, no matter how hard the ACLU and Amnesty Advocates try to redefine it.
The ACLU and various other groups want to make Maricopa County Sheriff Joe Arpaio, and other Law Men like him, the villain in this brouhaha. They are NOT the villain, they are not the BAD GUYS, they are Officers of The Law and are merely enforcing the LAW OF THE LAND.
ILLEGALS place a strain on OUR system, a strain that is breaking American tax payers.
In addition to being ILLEGAL, these people want to educate their children, at OUR expense. They want to live off of food stamps and welfare, or whatever the government is using to hand out *the dole* these days.
They want to have the finest in FREE healthcare, well, free to them, it’s provided at our expense, from OUR tax dollars. If you think I am exaggerating, try to get medical treatment at a state or county healthcare facility.
There’s a standing joke here in Texas about it too. If you need medical care at, say Parkland Hospital in Dallas for instance, walk in with a Border Patrol logo on your cap or jacket. The place will look like a ghost town in 3 minutes flat.
These ILLEGALS want everything America can GIVE them, the ACLU tells us it is their RIGHT to have the very best that America can give, and they, the ACLU, try to shame us into believing that it is OUR obligation to provide such finery to our ILLEGAL visitors.
I don’t deny anyone a *hand UP*, but these ILLEGALS aren’t here to build a better life, they are here to take and take and take, and then leave, to go back to whatever hell-hole it is that they will always refer to as HOME.
If an IMMIGRANT comes to America and seeks to become an AMERICAN, and nothing else, I welcome them with open arms, we are, after all, a nation of immigrants. When an ILLEGAL comes here to abuse our system, steal from our homes and businesses, as well as our welfare system, when they seek to rob the American people, I call them ILLEGALS and criminals.
And those that don’t see it that way only seek to further destroy this once great nation…

Well said Fred and right on the money. Immigrants come here legally and not only want to better themselves, they want to be a part of this nation and contribute to it. They do their best to learn English and ensure their children speak English. Although they have ties to the “old country”, they consider themselves Americans and put America first.
Out of consideration for the Constitution, I automatically discount any argument about illegal immigrants “rights” for the simple fact that non-citizens do not enjoy the same rights as citizens.
You want protection under the Constitution? Well, enter the country legally and apply for citizenship!
ps - here in Maricopa County, if you walked into an ER with a BP logo on your cap, the place would empty in about 3 seconds.
In Mexico, ALL sick Mexican citizens go to their State run hospital. By 8am, all waiting room seats are full, and the hallways are full, hardly any standing room left.
And ALL of them have their own Mexican Government issued Medical Card.
Yes, ALL OF THEM!!!
Over here in the USA, they NEVER mention this!
There are 2 cards all Mexicans have.
1. Mexican voter’s registration card.
2, Mexican Seguro Social Medical card.
The Illegals here NEVER mention this. They play stupid, poor, and dumb.
All are used to waiting in hallways sick, in their home country.
So, this is why they play the “victim” here, because we are so DUMB about their own Republic.
Remember, Mexico is a SOCIALIST run Country!

What if American hospitals started charging Mexico for the treatment their citizens are getting here? And, what if American courts started enforcing these charges and taking Mexican assets in the US to pay for this treatment? I would venture you would see the Mexican government put a clamp down on the border.

Amazing! A FEDERAL district court judge who seems to actually understand the Constitution insofar as the Bill of Rights actually applies to LAWFUL American citizens.
Isn’t it completely sad that we have to applaud a decision that is based but upon only common sense, knowing that common sense is essentially the LAST element applied in the federal court system?

I couldn’t agree with you more. Those that go through the process of coming here legally do so because they want to become Americans and I welcome them whole heartedly. Those that come to the United States illegally have no intention of becoming Americans and only want to take what they can get for free. If they were interested in being Americans they would not come here under the cover of darkness and willingly enter the “shadows of darkness.” It is about time for us to get serious about this issue.
