WASHINGTON (AP) - The Supreme Court ruled Monday that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.
The ruling could alter employment practices nationwide and make it harder to prove discrimination when there is no evidence it was intentional.
New Haven was wrong to scrap a promotion exam because no African-Americans and only two Hispanic firefighters were likely to be made lieutenants or captains based on the results, the court said Monday in a 5-4 decision. The city said that it had acted to avoid a lawsuit from minorities.
The ruling could give Sotomayor’s critics fresh ammunition two weeks before her Senate confirmation hearing. Conservatives say it shows she is a judicial activist who lets her own feelings color her decisions. On the other hand, liberal allies say her stance in the case demonstrates her restraint and unwillingness to go beyond established precedents.

Sonia Sotomayor is a judicial activist and she does let her feelings color her decisions. Her words and judicial decisions stand in testament. And this is one example;
“I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life,�?
Sotomayor is, in MY opinion, a racist of the 1st order. And again, in MY opinion, she is going to attempt to legislate from the bench. She is the worst choice for the SCOTUS that FREE Americans could ever face. She is however, the perfect choice for a POTUS that may very well be a Kenyan in disguise. A FAKE president.
I’m not saying that we can’t work with a moderate on the SCOTUS, but Sotomayor is NOT a moderate, not in ANY way. She is a Hispanic, female, racist, activist, and if she is seated on the SCOTUS, how can any more of her ridiculous rulings ever be overturned?
Employment has long been the victim of affirmative action. Applicants have been graded on a curve, test scores have been adjusted to make up for low scores.
I don’t care what color the police officer, fire fighter, doctor, teacher or any other person is. The color of their skin should NEVER be the reason for ANY person to hold a particular job or is promoted in the course OF that job.
Grading on a curve is a joke. Standardize testing is the only way to go. Promotions should be based on knowledge and merit. Set the criteria for pass and fail, if individuals don’t PASS, by the standard that is set for all, too bad, so sad. Maybe you just weren’t cut out for that particular position. No matter WHAT color you are.
If our educational system is to blame for certain groups not scoring as well as others, or not getting the same level of quality education as other groups, address the problem in the educational system. Don’t penalize the people because they made the highest score, and through no fault of their own just don’t happen to be the right race or color to make the necessary numbers add up!
Folks, we have some serious battles coming, the Sotomayor nomination is one of them. Cap and Trade in the Senate is another. Hammer your Senators unmercifully, be they Democrat, Republican or Independent. Hammer them to the point that they in NO WAY have ANY doubt where We, The People stand on these issues.
Accept nothing but their very best. Demand their very best!. If they give you less than the best, remove them from office.

Let’s see where Kay Bailey Hutchison falls in on this. She may vote against Cap and Trade, but even if she does, she is DONE in my opinion. No matter HOW she votes this time, she is a wild card at best and needs to be put to pasture.
