Inmate With Low I.Q. Nears Execution in Texas

HOUSTON — A 44-year-man whose lawyers claim he is mentally retarded is scheduled to be executed Thursday evening in Huntsville, Tex., unless the United States Supreme Court agrees to hear his case.

The man, Bobby Wayne Woods, whose I.Q. hovers around the level of a mildly retarded person’s, was convicted of the brutal killing of an 11-year-old girl in 1997 and sentenced to death.

The debate over whether he should be executed reflects the gray area left by the Supreme Court in 2002, when it ruled the mentally impaired were not eligible for the death penalty but left it up to state courts to interpret which inmates qualified as impaired.

Mr. Woods’s lawyers argue that his intelligence scores are low enough that he should be spared because of the Supreme Court ban in Atkins v. Virginia. But several courts have rejected that claim.

He was capable of committing the crime. He should be held accountable, and subsequently, he should be punished for his crime in an appropriate manner.

Maurie Levin, a University of Texas law professor who represents Mr. Woods, said in a pleading that “his I.Q. hovers around 70, the magical cutoff point for determining whether someone is mentally retarded.”

“He’s transparently childlike and simple,” she said. “It’s a travesty.”

DAMN the bleeding hearts! DAMN all of them. There truly IS a travesty here. That travesty took place with the MURDER of an innocent 11 year old girl. SHE was childlike, she may have been a simple child, I don’t know, but I do know this; everything she was, everything she may have become, every accomplishment and accolade she may have earned, was taken away from her when she was murdered.

The bleeding heart anti death penalty people, and libbers in general, all scream about the execution of a MURDERER but have no problem with killing an innocent baby.

On April 30, 1997, Woods entered the home of his ex-girlfriend, Schwanna Patterson, through an open window. He then beat and sexually assaulted Patterson’s 11-year-old daughter, then abducted her and her nine-year-old brother and took them to a cemetery. There, Woods severely beat the boy about the head, resulting in serious injury and murdered the girl by cutting her throat. SOURCE

It took the original story several paragraphs before they even mentioned the name of the victim or her mother. Of course the NYT is a lot more concerned with the defense of the murderer than they are the person that was murdered. It is a rare occasion that I will even use the NYT as a source for a story, but this time they were the only source I could readily find.

But that standard has been applied unevenly by state courts, according to a study by Cornell law professors. Some state courts in Mississippi, Alabama and Texas have held that inmates with scores as low as 66 are not impaired, while an inmate in California with a score of 84 was declared mentally retarded.

I can’t speak for ALL Texans, but speaking for ME, I don’t give a DAMN what standards they apply to ANY matter in the state of California! Those libber controlled moonbats didn’t have the guts to put ANY of the Manson clan to death of the heinous Tate/LaBianca murders, why should we here in Texas listen to, or give a DAMN about, what California does?

Courts in Texas repeatedly rejected Mr. Woods’s claims of mental impairment, although the state’s highest criminal court last year halted his execution to allow more hearings on the matter. That reprieve was lifted in October and this week, the Texas Board of Pardons and Paroles voted unanimously to reject a clemency request.

Well, that’s it then, strap him down, hook him up and wait a little while. When the SCOTUS turns him down, hit the button and shoot the juice to him.

The children’s mother, Schwanna Patterson, had kicked Mr. Woods out of her home just days before her children were attacked. She was convicted in 1998 of injury to her children though neglect, because, prosecutors said, she did nothing to stop the kidnapping. She served eight years in prison.

I’m not going to argue with the findings of the court, she let this monster into their lives, and he too Sarah’s life, maybe it was a full blown case of neglect, maybe it was LOVE, maybe it was sheer stupidity, I wasn’t there and I don’t know ALL the facts.

I won’t judge the mother, but I will say this, Schwanna Patterson lost her daughter and spent 8 years in prison, but she is alive. Sarah isn’t. Execute her murderer and be done with it.

Yes, I AM a strong proponent of the death penalty. I believe it should be used, and not just on a rare occasion. I also feel that forensics science has progressed to a point that these 10 year delays, and in some cases, many more years of delay, need to be eliminated.

Ron White, a comedian from Texas once said, “If you come to Texas and kill somebody, we kill you back. Other states are talking about doing away with the death penalty; in Texas we’re putting in an express lane.”

Maybe we need to spread that around to a few other states. Maybe Ron White should run for President. Just sayin’…

    I must be missing something.

    First, I’m guessing that “hovering around 70″ actually means above 70, not that that ought to excuse him.

    I’m also wondering why a retarded murder is any more deserving of being kept alive at taxpayer expense than a non-retarded murder. Being vicious AND slow is no better than merely being vicious.

    Bleeding heart liberals and conservatives often seem to care little for the victim while crying about the rights of the convicted and sentenced murderer who has been convicted and sentenced by a judge and jury. These people who are constantly seeking to overturn the parts of the Constitution they don’t like extend their activities to overturning convictions they also don’t like. What a miserable and disgusting bunch they are. No wonder liberals would exclude from the death penalty anyone with an IQ less that 84, they are trying to protect themselves and their constituents.

    You never hear these bleeding hearts offering to pay the tens of thousands of dollars it takes to keep these murders alive in prison. Never do they offer to foot the whole bill of in order to prevent an execution. This piece of garbage murdered a little girl and beat a little boy. His death is long overdue.

    Before I post, Glad to see you put “the good picture” up again! And as far as this lowest of primate life goes, I wouldn’t care if his IQ was zero before he commited this crime, (which it will be once it is properly adjusted by the only true justice system left in the U.S.A.) The death sentence is far too lenient for this type of crime. I won’t take too much space on your blog but the “proper” punishment involves steel cable, offending body parts a razor knife (rusty if possible) and lots of alcohol! Once again you are right on! Anyone who defends this lowlife should share his sentence!

    So, just to make sure I understand the portent of the information transcribed above:

    Let’s say I go out and kill somebody, out of sheer boredom. Once convicted of the murder, I can live on “death row” for the rest of my life, at taxpayer’s expense, as long as I am able to score BELOW 70 on their IQ tests, since killing a retarded murderer is considered bad form?

    How about if I kill the President (not sayin’ which one) and test below 70 on the IQ test? What then?

    Tell ya what. If the great state of Texas has any trouble finding competent personnel to start the lines and push the drugs? Which I highly doubt. But, say they do? I’m damned well willing as well as qualified.

    Pity, I would of loved running him thru my wood chipper.
    I could of “fertilized” part of the “north forty” with his remnants. Saved me on my fertilizer bill.
    And the wild hogs would of finished off any of the fatty parts spewed out that didn’t get caught up in the chipper’s teeth.

    I present this to bleeding hearts. My parents took on a foster child after I married. Rose was a victim of alcohol fetal syndrome. She had deformed knees, cerebral palsy and was mildly retarded. Mom worked painstakingly to teach her how to walk and control her muscles. She taught her social skills and through the workshop and my mother, Rose grew into an independent living, hard working woman. She has worked religiously at a McDonald’s for many years now. My siblings and I have seen to it she is cared for and is present at all family functions and church since my parents passed away. Since she has gotton older she struggles with a cane to walk because knee replacement isn’t an option for her deformity. She never misses work or church services. She never complains. She doesn’t blame her mother for being an alcoholic, she just pursues what success she can in her life. Rose is a wonderful, good hearted gal and a credit to my wonderful mother.

    My question to those who think that a retarded man who murders an 11 year old girl should not be sentenced to death for the crime, because he is retarded…. Well, rather than assume that his retardation is an excuse, why don’t you try asking yourself… where were all the bleeding hearts when this young man was a child???? Who was available to help him learn right from wrong??? My family did it with Rose and she is a good, moral woman and a responsible citizen. Retardation only becomes an EXCUSE for those who aren’t prepared to inconvenience themselves to help build a responsible citizen with a conscience!!! JMHO!!!

    I think you got it right Katie. Except I think the PC term is “challenged”. I don’t go PC though, because I have been around people who were classified mentally retarded all my life and I never considered that to be negative in light of most of them have other gifts, like Rose. She has a great heart and a work ethic that puts most young people to shame. It’s like if they aren’t gifted intellectually, they always have other gifts that come through. :-)
    My close friend growing up had a sister who was adopted and was mentally retarded due to her Mom being the victim of being drugged, raped and left in a ditch for dead. The part of her brain that wasn’t damaged… she had a photographic memory and could play piano beautifully. Left wingers don’t bother to figure these things out, because as you say, they like victimhood so much!!!!

    Why is this so difficult for these people to understand? Murder is murder. Add sexual assault and kidnapping of an eleven year old girl and the decision becomes clear:

    If he functions well enough to have a girlfriend and a relationship. He’s certainly not retarded. To rape and murder your girlfriends daughter takes conscious thought and planning. More than enough for a 1st degree murder conviction. The sentence appears appropriate and should be carried out as soon as possible.
